1. Applicability of These Terms and Conditions

These General Terms and Conditions for Visitors apply to every agreement between Tutankhamun, hereinafter referred to as “Stardust,” and a Visitor.

2. Definitions

For the purposes of these General Terms and Conditions for Visitors, the following definitions apply:

• Visitor: the person who enters into an agreement with Stardust as a visitor to attend an Event organised by or on behalf of Stardust.

• Third-Party Producer: a third party directly or indirectly involved as the organiser or (executive) producer of an Event.

• Third-Party Ticket Seller: a third party appointed by or on behalf of Stardust as an official seller of Admission Tickets.

• Service Fees: additional fees (in addition to the price of the Admission Ticket) that Stardust or a Third-Party Ticket Seller may charge to cover transaction and other costs.

• Venue: the location hired by Stardust or the Third-Party Producer where the Event takes place (in this case, the Olympic Stadium in Amsterdam).

• Admission Ticket: a physical or digital document granting the right of admission to an Event and containing a unique code that can be read by a scanner.

• Event: the event organised by Stardust and held at a Venue hired by Stardust (in this case, Tutankhamun – The Immersive Experience at the Olympic Stadium in Amsterdam).

3. Admission Tickets

1. The agreement between Stardust and the Visitor is concluded when the Visitor purchases an Admission Ticket for the Event. Admission Tickets may be purchased either through the Stardust website and the website of the relevant Event, or through Third-Party Ticket Sellers.

2. An Admission Ticket is issued once only and entitles one Visitor to admission to the Event.

3. The person who first presents the Admission Ticket at the Event will be granted admission. Stardust will assume that this person is also the rightful holder of the Admission Ticket. Stardust is not obliged to verify the validity of the Admission Ticket and/or the identity of the holder.

4. Once the Admission Ticket has been made available to the Visitor electronically or physically, the Visitor bears the risk of loss, theft, damage or misuse of the Admission Ticket. Stardust can only guarantee the validity of an Admission Ticket if it was purchased from Stardust or a Third-Party Ticket Seller. The Visitor bears the burden of proving that this is the case.

5. If the Visitor has not received an Admission Ticket (including in the spam folder of the Visitor’s email account), despite being able to demonstrate that payment has been made, the Visitor must report this at least 24 hours before the intended visit to the Event. If the Admission Ticket was purchased through (a website of) Stardust or a Third-Party Ticket Seller, the Visitor will receive a new Admission Ticket and the original Admission Ticket will be invalidated. The Visitor bears the burden of proving that the Admission Ticket was purchased through (a website of) Stardust or a Third-Party Ticket Seller. In the absence of such proof, Stardust is not obliged to issue a replacement Admission Ticket.

6. Stardust reserves the right to impose a maximum number of Admission Tickets that may be ordered per Visitor.

7. Admission Tickets cannot be returned or exchanged unless otherwise provided for in these Terms and Conditions.

4. Sale and Transfer of the Admission Ticket

1. The Visitor is required to keep the Admission Ticket for their own use. Resale is not permitted. If the Visitor is unable to attend, they may give the Admission Ticket(s) they have purchased to a third party free of charge.

2. The Visitor may not advertise the Event with the intention of reselling an Admission Ticket.

3. If the Visitor gives their Admission Ticket to a third party, the Visitor is required to inform that third party of these General Terms and Conditions for Visitors and, where possible, provide them with a physical or electronic copy. The Visitor is responsible for ensuring that the third party complies with these Terms and Conditions.

4. Stardust is entitled to invalidate any Admission Ticket that has been resold in violation of these General Terms and Conditions for Visitors or that is used for commercial purposes. An invalidated Admission Ticket does not entitle the holder to admission to the Event.

5. Venue Rules

1. Any general terms and conditions and house rules of the Venue where the Event takes place apply in addition to these General Terms and Conditions for Visitors, but solely in relation to the Visitor’s attendance at the Venue on the day of the Event.

2. The Visitor is required to follow all instructions given by Venue staff and Stardust staff.

3. The Visitor is required to cooperate with any security checks upon entering the Event, including searches of the person and/or bags. If the Visitor refuses to cooperate, Stardust may deny the Visitor admission to the Event without any right to a refund.

4. If the Visitor arrives late (i.e. after the time slot for which the Admission Ticket was purchased), the Visitor must follow the instructions of Stardust staff. In order to avoid disrupting the Event, the Visitor will only be admitted at a time determined by Stardust staff and subject to availability.

5. Recording the Event in whole or in part, including photography, filming and making audio and/or visual recordings using any type of device, is not permitted.

6. For security reasons, the Venue and/or Stardust may use CCTV surveillance in and around the Event and the Venue. CCTV footage will not be retained for longer than strictly necessary.

6. Rights of Stardust

1. If the Visitor breaches one or more provisions of these General Terms and Conditions for Visitors, the Visitor will automatically be deemed to be in default without any further notice of default being required. In such case, Stardust is entitled to:

2. terminate the purchase agreement with immediate effect and without judicial intervention; and

3. deny the Visitor admission or further admission to the Event, for example by invalidating the Admission Ticket, without the Visitor being entitled to a refund.

4. An invalidated Admission Ticket no longer entitles the holder to admission to the Event.

5. Stardust may make audio and/or visual recordings of the Event for promotional purposes, including use on social media and in advertising campaigns. The Visitor may occasionally be recognisable in such recordings.

7. Force Majeure

1. In addition to Article 6:75 of the Dutch Civil Code, any failure by Stardust to fulfil its obligations shall not be attributable to Stardust in the event of force majeure. Force majeure includes any circumstance beyond Stardust’s control – even if such circumstance could have been foreseen as a possibility at the time the agreement was concluded – that temporarily or permanently prevents performance of the agreement, including:

2. strikes, road blockades, public transport strikes or weather conditions that may affect the Event itself and/or public transport;

3. terrorist attacks, war, riots, fire or actions by the police, armed forces and/or fire brigade;

4. a lockdown or other restrictive measure imposed by the authorities for the protection of public health;

5. illness and/or cancellation of staff and/or bankruptcy of stakeholders involved in the Event;

6. nuisance and/or unlawful acts caused by third parties, including other Visitors;

7. failure of facilities to function properly due to an emergency, maintenance work or other events taking place in or around the Venue.

8. In the event of force majeure, Stardust has the right either to postpone the Event or transfer the validity of an Admission Ticket to another date, or to cancel the Event.

9. Although Stardust will make reasonable efforts to inform the Visitor by email of any cancellation, Stardust cannot guarantee that each Visitor will be individually informed of the cancellation before the scheduled date of their visit to the Event. Stardust shall not be liable for any travel expenses or other costs already incurred by the Visitor in connection with a cancelled Event.

10. If Stardust decides to cancel the Event, Stardust (or, where applicable, the Third-Party Ticket Seller on behalf of Stardust) will refund the price of the Admission Ticket to the Visitor. The refund will be made no later than three months after the date of the cancelled Event. Admission Tickets purchased electronically will automatically be invalidated and will therefore no longer be valid for any future Events. In the event of cancellation, physically purchased Admission Tickets may be returned to the location where the Admission Ticket was purchased.

11. If Stardust decides to postpone an Event to another date, the Admission Ticket will remain valid for the new date on which the Event will take place. If the Visitor is unable or does not wish to attend the Event on the new date, the Visitor is entitled to return the Admission Ticket to the Third-Party Ticket Seller in exchange for a refund of the amount paid by the Visitor to Stardust or the Third-Party Ticket Seller. A refund will only be issued if the Visitor submits a valid and undamaged Admission Ticket in a timely manner.

12. If the Event is postponed to a date later than the originally selected date, the Visitor will only be entitled to a refund if the Admission Ticket is returned to the party from which it was purchased within six weeks of the announcement of the new Event date. If the Visitor does not submit a refund request within this six-week period, this will be deemed to constitute acceptance of the postponement and the right to a refund will lapse.

13. In the event of force majeure, only a Visitor who qualifies as a consumer and who purchased the Admission Ticket from Stardust or a Third-Party Ticket Seller is entitled to a refund of the Service Fees. In the event of force majeure, Stardust is not obliged to compensate any other losses or damages, even if Stardust derives any benefit as a result of the force majeure. The Visitor is also not entitled to admission to another Event.

8. Liability

1. Stardust shall only be liable for any property damage, consequential loss and/or personal injury suffered by the Visitor if such damage or injury is caused by wilful misconduct or deliberate recklessness on the part of Stardust and/or third parties engaged by Stardust. Any compensation shall never exceed the amount paid out by Stardust’s insurer in the relevant case. If, for any reason, the insurer does not make a payment, Stardust’s liability shall be limited to €25,000 per event or series of related events. Claims relating to damage caused by the Venue must be submitted directly to the Venue.

2. Stardust’s liability is in any event excluded for:

3. damage resulting from the actions of third parties, including tenants of other areas at or within the Venue and persons engaged by such third parties;

4. damage resulting from failure to follow instructions given by Stardust staff;

5. damage resulting from failure to comply with the Venue’s house rules;

6. consequential loss or damage resulting from unforeseeable changes to the start and end times of the Event to which the agreement between Stardust and the Visitor relates;

7. personal injury that can reasonably be attributed to the Venue;

8. damage caused in any way by other Visitors.

9. Offers, programme announcements, communications, prices or other information provided by or on behalf of Stardust regarding an Event are non-binding. Stardust shall not be liable for any errors made by Stardust or third parties in such information, nor for errors made by third parties in the advance sale or sale of tickets, including the Third-Party Ticket Seller.

10. The following circumstances do not entitle the Visitor to a refund of the Admission Ticket:

11. last-minute changes to the content of the Event, including but not limited to changes resulting from technical malfunctions;

12. last-minute changes relating to minor elements of the Event, including but not limited to the photobooth.

13. The Visitor acknowledges that the Event makes extensive use of amplified music and special effects. In particular, Stardust draws attention to the use of VR and projections. By attending the Event, the Visitor acknowledges and accepts these elements.

14. Unless the programme information on Stardust’s website specifies a recommended minimum age, the Event is generally considered suitable for all ages. However, the final assessment of whether the Event is suitable for minor Visitors remains the responsibility of the adult(s) accompanying the minor(s). The perceived suitability or unsuitability of the Event therefore does not constitute grounds for a refund. The VR experiences at the Event are available to Visitors aged 5 and over.

9. Personal Data

The Visitor’s personal data recorded by Stardust or the Third-Party Ticket Seller in connection with the issue of an Admission Ticket will be included in the records of Stardust and/or the Third-Party Ticket Seller. Each party acts as an independent data controller with respect to its own processing activities. Stardust processes personal data in accordance with applicable laws and regulations.

10. Final Provisions

1. If any provision of these General Terms and Conditions for Visitors is found to be null, void or otherwise unenforceable, this shall not affect the validity of the remaining provisions.

2. These General Terms and Conditions for Visitors and the agreement between the Visitor and Stardust are governed by Dutch law.

3. Any disputes arising from the agreement between Stardust and the Visitor shall be submitted exclusively to the competent court in the jurisdiction of Stardust’s registered office, unless otherwise expressly provided by law.

4. These General Terms and Conditions for Visitors are published on the Dutch website of Tutankhamun – The Immersive Experience, which has been specifically created by Stardust for the Amsterdam edition of this Event.
